Using the site, the method and the Growth Score name.

These terms cover three distinct things: the site, the published method and the Growth Score name. The method is free to read and implement. Use of the name and the licensed layers is subject to the conditions below and any signed licence agreement.

1. Who and what these terms cover

This site is operated by Closing Foundry Ltd, registered in England and Wales, company number 14629519. By using the site, you agree to these terms.

These terms cover the site, the published method and the free assessment. They do not replace a signed licence agreement. If an institution has a signed agreement with Closing Foundry, that agreement governs the relevant use and prevails where the two documents conflict.

2. The method licence and the Growth Score name

The published measurement method, including the model, scales, arithmetic, bands and version record, is available to read, implement and administer, including commercially, without charge or permission from Closing Foundry.

Use of the Growth Score name is reserved to implementations that return the expected output for every published conformance vector at a stated method version. An implementation that does not pass those vectors must not describe its output as a Growth Score.

You must not modify the questions, scales, arithmetic or bands and continue to use the Growth Score name. Changes to those elements produce a different measure and must not be presented as the same method version.

The following elements are not part of the public method licence: the diagnostic library, action and routing logic, lens-rule precedence, confidence thresholds, reporting layer and result register.

3. What Growth Score is not

  • Advice. Growth Score is a measurement instrument, not financial, legal, investment or professional advice. Users remain responsible for the decisions they make.
  • Credit and significant decisions. Growth Score must not be used as an input to lending, affordability, pricing, insurance, eligibility, employment or other decisions producing legal or similarly significant effects for a person or business.
  • Self-reported data. A result records what a company reports about itself. It is not independent verification of those statements.
  • Prediction. Growth Score measures selected conditions upstream of growth and whether they change over time. It does not forecast growth, funding or another outcome.

4. Taking the assessment

The assessment and the result are free to the company being measured. There is no upgrade, paywall or charge at any stage.

Answer based on the company's current practice and evidence. A result reflects the answers provided. A later rescore should use the same standard so the difference can be reviewed as movement.

A company may share its own result with anyone it chooses. Closing Foundry will not share that result with an institution unless the company has consented to the sharing.

5. Acceptable use

You must not reverse-engineer unpublished layers, scrape the site at volume, submit an assessment for a company without its knowledge, misrepresent a result, present an unverified or modified output as a Growth Score, or use the site unlawfully.

6. Intellectual property and ownership

The method is made available on the terms in section 2. Closing Foundry retains rights in the diagnostic content, reporting, software and Growth Score name unless a signed agreement states otherwise. Nothing on this site transfers ownership of those rights.

7. Availability

The site and the free assessment are provided as available. We do not promise uninterrupted availability. Service levels for licensees are set out in the applicable agreement.

8. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be excluded.

Subject to those limits and to the extent permitted by law, Closing Foundry is not liable for loss of profit, revenue, business or goodwill, or for indirect or consequential loss, arising from use of the site, the free assessment or the published method. Total liability for free use of the site or the assessment is limited to: amount to be confirmed.

9. Changes and governing law

We may update these terms and will show the latest date here. Superseded method versions remain available at their permanent addresses.

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
